Terms & Conditions

 

When you place an order for a car hire experience with us via this website you are entering into a contract with us on the basis of these terms and conditions.  Your order and these terms and conditions form the contract between us.   Please ensure you read these terms and conditions carefully.  We are Classic Car Adventures Limited (Company number 13811586) and the words “we”, “us” and “our” when used in these terms should be interpreted accordingly.  If there is anything you do not understand or wish to discuss, please contact us by email or phone.

 

Please note that you are entering into a legally binding contract to hire a vehicle for the set date stated in your order.  As such, under the Consumer Contracts Regulations, you do not have the right to cancel your order should you change your mind.

 

IMPORTANT: In placing an order with us you are not hiring a vehicle for your personal use, you are entering into a contract to hire such vehicle(s) (which we select from classic cars that we have available) as part of a driving experience along with other customers and as part of a guided tour on a set-route, commencing at a set time, with prescribed breaks and a definite start and end location and time.  You must adhere to the conditions in section 6 below (“Obligations on the Day of Hire”) in order for the experience to run smoothly and enjoyably for you and our other customers.

 

1. Persons Permitted to Drive and Physical Restrictions (Drivers and Passengers).

You may wish to be accompanied by one passenger on the day of hire, but your passenger may not drive the vehicle, unless authorised as an Additional Driver under our contract with you.   The only persons permitted to drive the hire vehicle are you and/or one Additional driver who has been officially authorised to drive the vehicle.  See section 4 below (“Additional Driver”) for the conditions that apply to any Additional Driver.

Please be aware that all of our vehicles are British two-seater classic cars and are much smaller than modern vehicles (and even much smaller than cars designed in the USA of a similar age).  In particular, anyone taller than 6”4 feet (1.95m), or weighing more than 20 stone (127kg) will not be able to fit in our vehicles.  If a driver is of a physical size close to or approaching these measurements, it may be uncomfortable and/or dangerous for such persons to drive the vehicles, or to ride as a passenger, and we would strongly recommend contacting us via email info@classiccaradventures.co.uk  or telephone 07700177798 before booking, to avoid disappointment.

 

2. Documents Required.

Our contract with you is conditional on you meeting the criteria set out below (see “3. Drivers Licence and Insurance Requirements”).  PLEASE READ SECTION 2 AND 3 OF THESE TERMS CAREFULLY.

Documents Required in Advance: IMPORTANT – copies of the following must be provided to us via email no sooner than 21 days before your date of hire and no later than 7 days before your date of hire:

  • DVLA Licence Code: As a condition of placing an order with us you are agreeing that you will use DVLA’s online licence checker (https://www.gov.uk/view-driving-licence) to share your licence information with us to ensure that you meet our insurance requirements. This requires you to input your driving licence number, national insurance number and postcode. This will generate a unique identification code that will need to be sent to us by email. 

  • Driving Licence: You and any Additional Driver must provide us with a copy or your Full United Kingdom photocard driving licence by email.  Please also bring the original licence(s) with you on the day of hire. 

  • Two Other Forms of ID: In addition to your Full United Kingdom photocard driving licence, copies of two other forms of identity should be sent to us by email for you and any Additional Driver.   This must be bank statements or utility bills showing current residential address. Both must be dated within 60 days from the date of hire.  

All names and addresses must match and all documents /DVLA codes should be sent to info@classiccaradventures.co.uk quoting the name and address of the person who placed the order with us.  Copies of said documents will be taken on the day of hire and kept by us in accordance with our                              .

 

IMPORTANT: We are entitled to cancel our contract with you and cancel your booking in any of the following circumstances:

  • If your driving licence does not meet our insurance requirements (see “3. Drivers Licence and Insurance Requirements”)

  • If you do not email us with a valid DVLA identification code by the date that is 7 days before your date of hire.

  • If you do not email copies of your Driving Licence and Two Other Forms of ID (as set out above) by the date that is 7 days before your date of hire.

  • If you do not bring your Driving Licence and Two Other Forms of ID with you on the day of your hire.

 

3. Drivers Licence and Insurance Requirements.

PLEASE READ SECTION 2 AND 3 OF THESE TERMS CAREFULLY.

Drivers must be aged between 25 and 75 years of age. Drivers must have held a Full UK or EU Driving Licence for a minimum of two years. Drivers must have not been involved in more than one incident which was their fault in the last three years. Drivers must have not had the licence revoked or have been banned from driving in the last three years. Drivers must have no more than 2 minor convictions or more than six penalty points either obtained or pending. Drivers must have not obtained a BA, DD UT or other serious conviction/s.

 

4. Additional Driver.

You may wish for your passenger to become an Additional Driver.  The “Additional Driver option” can be added to your order at an additional cost of £25 (“Additional Driver Charge”) by email request to info@classiccaradventures.co.uk no later than 1 days before your date of hire and subject to the Additional Driver having provided the Documentation and meeting the licence and insurance requirements in section 2 and 3 above.  This option does not mean that you each drive a separate vehicle at the same time:- by adding an Additional Driver to your order you are agreeing to share the time driving the vehicle with your Additional Driver and you will each have less time driving the vehicle.  Due to the nature of our experience and the need to safely manage driver swap-overs, this may also mean that you or your Additional Driver will not be able to drive all of the vehicles available on the day of hire.   Additional Drivers are subject to the same terms and conditions as the named driver and must supply all documentation, and a valid DVLA Licence Check Code. If an Additional Driver does not meet the requirements set out in clause 2 and clause 3 above, then we may refuse to accept the Additional Driver.  In these circumstances you will be entitled to a refund of only the Additional Driver Charge, but otherwise your contract with us remains valid and binding on you as the sole authorised driver.  You are not entitled to cancel your contract with us and you are not entitled to a refund of any other amounts you have paid in these circumstances.

 

5. Payment and Our Charges.

We will take payment from you when you place your online order via our website.  The fees paid are inclusive of hire charges and we provide comprehensive insurance.  As part of the experience we may suggest breaks at cafes, public houses or restaurants, but no refreshments or meals are provided as part of the experience.  Any refreshments or meals that you may choose to purchase on the day must be paid for at your own cost.  For terms relating to cancellation charges and our insurance excess please see sections 10 and 12 of these terms and conditions.

 

6. Your Obligations on the Day of Hire.

IMPORTANT: All vehicles must be collected from Classic Car Adventures Ltd, Unit 5a, Leek Road, Buxton SK17 6UQ on the day of hire.  Full day tour experiences commence at this address at 10am.  Half day tour experiences commence at this address either 9.30am (morning tour) or 15.30pm (evening tour).  If you do not arrive within 20 minutes of these times, we may cancel the contract by virtue if the fact that you have failed to arrive promptly (see section 9 below).  These times may be subject to change, in which case we will notify you of the amended time in advance and no less than 24 hours before your booking.  This is out of fairness to our other customers taking part in the tour and due to the need for us to collect ID paperwork from you and to take insurance excess before the experience can begin.

On our experience days we endeavour to give you the opportunity to drive four of our classic car hire vehicles (see section 8 Vehicle Availability below).  The experience is a self-driven route through the Peak District, guided by a support vehicle and our guide and in conjunction with other customers, driving the other hire vehicles.  At the start of the experience you will be given a map of the route and an itinerary for the experience.  The tour will stop at various points throughout the day, to switch cars, take pictures and at pubs and cafes where you may wish to purchase refreshments (No meals or drinks not included).  In entering into the contract with us you are agreeing to the following obligations in order for the experience to run smoothly and enjoyably for you and our other customers:-

  • You agree to the times for arrival and departure that our guide provides for each leg of the experience;

  • You agree to switch between hire vehicles provided by us on the day, as frequently or in any such manner as our guide determines in their absolute discretion;

  • You agree to follow the guide vehicle on the prescribed route for the tour.  In the event that you become lost or lose sight of the guide vehicle you must follow the instructions given in the map and itinerary provided at the start of the experience to the next stop;

  • In the event that you are unable to locate our guide vehicle and re-join the tour experience you must return in the vehicle to Classic Car Adventures Ltd, Unit 5a, Leek Road, Buxton SK17 6UQ and wait with the vehicle until our guide meets you there;

  • You agree to treat our guide and our other customers with respect and politeness at all times.

 

7. Vehicle Seating Capacity: Two Person Limit.

The number of persons carried in the vehicle must not exceed two persons.  If you have chosen to add an Additional Driver to your order, then at any point in time, either you or your Additional Driver will be the passenger in the hire vehicle.

 

8. Vehicle Availability

The nature of our business means the number and choice of vehicles is limited. Vehicles are available seasonally, April to October. We can possibly arrange outside of these dates by prior arrangement.  It is in the nature of classic cars that they are less reliable than modern vehicles and in booking with us you understand that there is an inherent risk of vehicles not being available due to mechanical breakdown or other issues concerning the vehicles.  We therefore can make no guarantee that the vehicles available to hire on the day of hire will be those advertised on our website.   The vehicles listed on our website are illustrative of the vehicles we have available at the time of booking, but this is subject to change.  On our experience days we endeavour to give you the opportunity to drive four of our classic car hire vehicles in conjunction with other customers, driving the other hire vehicles.  However, circumstances may arise outside of our control such as late cancellations from other customers that mean we have less vehicles available as part of the experience.   The tour will stop at various points throughout the day, to switch cars.  We will endeavour to plan these vehicle switches so that each customer gets an experience of driving each vehicle, but this cannot be guaranteed and it is not possible for us to guarantee the time each customer gets to experience driving each car be equal.  If you are sharing the experience with an Additional Driver then you will naturally experience less time driving each vehicle or may not be able to drive each vehicle on the day.

 

9. Expiration of Hire Period and Returning the Vehicle

You must ensure the hire vehicle is returned to us at Classic Car Adventures Ltd, Unit 5a, Leek Road, Buxton SK17 6UQ before the expiration of time shown on the itinerary provided you on the day of hire. If you become separated from the guide vehicle the likely late return of the hire vehicle should be reported as soon as possible to us.  It is not possible to extend the period of hire beyond the hours shown on the itinerary and in any case the hire cannot extend in any circumstances beyond the one day of hire.  For late returns additional hire charges will be charged to your credit or debit card. Failure to inform us of expected late return will result in the hire vehicle being reported as stolen.

Please Note: Vehicles are fitted with tracking devices.

 

10.  Where You Wish to Cancel or Where We have to Cancel Because You Do Not Meet Your Obligations:

Please note that you are entering into a legally binding contract to hire a vehicle for the set date stated in your order.  As such, under the Consumer Contracts Regulations, you do not have the right to cancel your order should you change your mind.  We understand however that circumstances change, and if you are no longer able to attend on the day of your booking we will endeavour to take reasonable steps to amend your booking, or if that is not possible, to accept your cancellation. 

In these circumstances and in circumstances were we have to terminate our contract with you because you have not met your obligations under the contract, we are entitled to deduct cancellation charges from the amount you have paid us.   Please see details of our cancellation charges in the table below – these charges reflect the loss we suffer and the costs we incur as a result of your cancellation, of you failing to meet the contract / documentation / licence requirements or of you failing to arrive promptly on your hire date).

11. Weather Cancellation/ Other Circumstance Where We Are Forced to Cancel

Occasionally we may have to cancel or rearrange your experience due to adverse weather, mechanical breakdown or other events beyond our control. If this is likely we will notify you immediately. We will offer you an alternative date, depending on the experience and your circumstances or we will provide a full refund. IMPORTANT: We are not responsible for the consequential costs you may incur due to any such cancellation (for example: your accommodation or travel costs).  It is in the nature of classic cars that they are less reliable than modern vehicles and in booking with us you understand that there is an inherent risk of cancellation due to mechanical breakdown or other issues concerning the vehicles outside of our control. In such circumstances the company will endeavour to give you at least 24 hours’ notice in writing via email, text and/or via telephone, but that may not always be possible.

 

12. Insurance, Insurance Excess and Your Liability for Loss and/or Damage

Fully comprehensive insurance cover is provided, subject to an insurance excess in the sum of £200, for the day of hire. A pre-authorised amount corresponding to the insurance excess must be made prior to hire on a credit or debit card with an appropriate credit limit. If the vehicle is stolen during the period of hire or is returned damaged, the insurance excess will be processed on the applicable credit or debit card in full to cover the theft or repair of any of our vehicles whilst in your possession. In the case of repair (when the final cost of the work is known) if after deducting the cost of repair a partial refund is due, this will be paid by bank transfer. Where a hire vehicle is stolen or damaged while you or the Additional Driver is (a) under the influence of drugs and/or alcohol, or (b) convicted of offences of dangerous, reckless or careless driving, or (c) the vehicle is driven by an unauthorised driver, or (d) when you or your Additional Driver is negligent or otherwise engaged in an unlawful act, you are wholly responsible and liable for the damage or theft (i.e. the full cost to replace or repair).

 

13. Collision Damage Waiver

Our Collision Damage Waiver (CDW) policy provides additional protection in the event of an accident or damage to our vehicles while they are under your control as it prevents you from having to pay the £200 excess on any insurance claim as a result of damage or theft of the vehicle in your possession.  The price of our CDW policy is £15 and this can be purchased at the time you place your order or at any time prior to commencement of hire.

 

14. Accidents and Breakdown.

In the event of an accident or breakdown all relevant details must be recorded particularly those involving another driver, vehicle and/or persons and property. You must report the incident immediately to the Police/Emergency Services and to us, as appropriate. In the event of an accident national breakdown cover does not include vehicle recovery which is the sole responsibility of the hirer. No admission of liability should be made until any accident has been fully investigated by the insurers.

 

15. Your Responsibility When Using our Vehicles.

a) You are required to act in good faith and respect these terms and conditions of hire.

b) You are required to ensure the hire vehicle is used carefully and that the vehicle is returned in a clean condition.

c) You are required to ensure the hire vehicle is driven on well surfaced roads. Vehicles should not be used on unsurfaced roads, tracks, off road or on racing circuits.

d) You are required to maintain the vehicle in the condition it was supplied and ensure that no smoking takes place in the hire vehicle. No pets are allowed.

e) You are required to ensure the hire vehicle is not used for carrying of goods of an explosive, dangerous, hazardous or illegal nature or for the carriage of goods or passengers for hire and reward or any other form of profit or reward.

f) You are responsible for any safety equipment (e.g. warning triangle, high visibility jacket), tools, spare parts, personal possessions and other goods carried and stored in the vehicle during the period of hire and us cannot be held liable for any damages or losses suffered.

g) You are required to inform us immediately in the event of damage or accident to the hire vehicle. When an accident occurs you should follow the normal procedure in such circumstances and where appropriate obtain the details of the driver and vehicle if another vehicle is involved.

h) You are required to ensure that the vehicle is never driven under the influence of alcohol and/or drugs.

i) You are responsible for any offences committed while the hire agreement is in force and will indemnify us for all fines, impositions and penalties or consequences occasioned by the use of the vehicle prior to the vehicle being returned to our premises at the end of the hire period.

j) you have sole responsibility for the safe return of the hire vehicle in your possession. The driver and any additional driver must adhere to The Road Traffic Acts and The Highway Code.

k) You must look after the vehicle at all times. This includes the set of keys you will be given. You must lock the vehicle each time you are not using it.

l) You must protect the vehicle against bad weather which can cause damage (this may mean stopping where it is safe to do so to raise foldable roofs in adverse weather).

m) Whilst the hire vehicle will usually contain a full tank of fuel, on Full day tours you may be required to fill the petrol tank.  You must ensure that the correct fuel is used. All of our vehicles use premium unleaded.

 

16. Vehicle Condition

We will explain and familiarise you with the cars you will be driving.  You are the only person who can determine whether you are comfortable and competent to drive the cars. It is your responsibility to decide whether you are competent to drive.  If you accept the keys you have taken responsibility for this. We will inspect all vehicles before your experience and after before each “vehicle swap” and note any damage or defects.  Each vehicle is accompanied by a document that details the damage or defects it has.  When getting into the vehicle you are responsible for checking the car thoroughly and ensuring that you inform us of any damage or defects not shown on  the paperwork records any damage correctly.  You are welcome to take photographs of any defects if you wish.

You can expect the car we provide to be in good condition for its type, being presentable and well maintained by our own workshop.  Our priority is to provide you with a reliable, safe car.  However, these are old cars and some deterioration to the bodywork and interior is unavoidable.  Please be realistic.  Similarly, certain non-essential items such as the radio or map reading lights may not function effectively.  If the vehicle develops a fault or issue during hire - however large or small - you must notify us immediately. We will provide advice and assistance or arrange recovery of the car.  You will be responsible for any damage caused to the car if you continue to drive it with a known fault.   We will inspect the car on its return and note any variance in the condition.   You will have to pay for reasonable costs of repair if:

    i. Damage occurs to the interior of the car as this is not covered by comprehensive insurance; or

    ii. You have damaged the outside of the vehicle not covered by insurance, e.g. an alloy wheel rim; or

  iii. The repair cost for the damage is less than the excess of £200 and (at our discretion) we have opted to repair the vehicle without claiming on our insurance cover, in which case we will deduct the reasonable costs of repair from your excess payment and refund the balance.

 

17. Our Responsibility and Types of Loss We are Not Responsible For

We will provide the car in a roadworthy condition and ensures the vehicle is taxed and has a MOT Certificate in accordance with the requirements of The Road Traffic Act.

We are responsible if someone is injured or dies as a result of our negligent act or failure to act.

We are responsible for losses you suffer as a result of us breaking this agreement if the losses are a foreseeable consequence of us breaking this agreement, but not for losses that are unforeseeable. Foreseeable losses are those that could have been envisaged by you and us at the time the vehicle was hired. We are not responsible for indirect losses which happen as a side effect of the main loss or damage whether or not foreseeable by you and us (such as loss of opportunity).

IMPORTANT:  Please see section 11 above  (“Weather Cancellation/ Other Circumstance Where We Are Forced to Cancel”).  Note we are not responsible for the consequential costs you may incur due to any such cancellation (for example: your accommodation or travel costs). 

 

18. Governing Law.

Any agreement between the us and you and/or any other party is subject to English Law.
